DATA PRIVACY

Recent years have seen the adoption and strengthening of laws and regulations designed to protect personally information (PII). Enterprises have struggled to adapt to this new reality. While many have had mature Data Security programs in place for years, Data Privacy is focused on the permissible use of data by people and systems that have properly been granted access to it. This is a new paradigm that was not a concern in the past when all that really mattered was access alone.

At the same time as the treatment of PII became important, there has been tremendous growth in the acquisition of licensed data for analytics needs. The use of this data is subject to contractual restrictions, often with contractual penalties if a contract is breached.

On top of this, new tools have allowed enterprises to easily scrape data from Internet sites – sites which have clear terms and conditions for all users. This is yet another legal dimension concerning data that must be dealt with.

Even beyond what we have already discussed there are contracts with customers, suppliers, partners, and other entities that cover data concerns. There are also policies about data that reflect the values of the enterprise, and questions about the ethical management of data that go beyond legal concerns.

At Data Millennium we believe it is neither desirable nor efficient to compartmentalize all these legal concerns, but rather to bring them all under the umbrella of Data Privacy, which we define as:

ENSURING THAT THE ENTERPRISE MEETS THE OBLIGATIONS IT HAS, AND KEEPS THE PROMISES IT MAKES, FOR THE DATA IT MANAGES.

It is falling to Data Governance programs to make sure that Data Privacy in this broad sense is implemented across the enterprise. Data Governance is already dealing with data-centric projects, so it makes sense to cover Data Privacy too. Of course, Legal, Procurement, and other units have a role to play but Data Governance can provide overall coordination.
